These Terms of Use ("Terms" or "Agreement") govern access to and use of Trash Bandit™, TrashBandit.vip™, and all websites, applications, progressive web applications, games, marketplaces, maps, services, features, and other platforms operated by 1585214 B.C. LTD. d/b/a Trash Bandit™ ("Trash Bandit," "TrashBandit.vip," "we," "us," or "our"), a British Columbia, Canada company.
Our Services may operate through or in connection with:

- trashbandit.xyz
- trashbandit.store
- trashbandit.club
- trashbandit.shop
- Trash Bandit mobile applications
- Trash Bandit progressive web applications
- other websites, applications, platforms, or services identified by us as part of Trash Bandit
Collectively, these are referred to as the "Services."
Trash Bandit is a location-based interactive entertainment, exploration, gaming, rewards, community, and marketplace platform. Features may allow users to explore real-world locations, complete Missions and Challenges, participate in environmental cleanup activities, discover Virtual Treasure, participate in role-playing gameplay, create locations and game content, interact with other users, earn Points and Rewards, and participate in marketplace activities.
By registering for, accessing, installing, or using any of the Services, you agree to these Terms and all policies expressly incorporated into them.
If you do not agree to these Terms, do not access or use the Services.
These Terms apply worldwide, subject to mandatory laws that cannot legally be excluded or waived.
1. DEFINITIONS
For purposes of these Terms:
"Account" means a registered Trash Bandit user account.
"Bounty" means a challenge, activity, mission, funded activity, or other game experience designated as a bounty through the Services.
"Trash Bounty" means an environmental cleanup activity or challenge involving the removal, collection, documentation, or reporting of litter or waste.
"Physical Bounty" means a physical container, object, cache, or other permitted physical item placed in a real-world location for use with the Services.
"Mission" means a game, exploration, recreational, environmental, community, tourism, promotional, or other activity presented through the Services.
"Event" means a temporary user-created, business-created, or Trash Bandit-created listing, activity, gathering, mission group, challenge, or game experience.
"Hideout" means a persistent or semi-persistent player-created virtual location or game location associated with a real-world map position.
"Inn" means a virtual role-playing game location or mechanic that may permit character recovery, healing, interaction, progression, or related gameplay.
"Virtual Treasure" means any virtual treasure, item, collectible, artwork, reward, game asset, or other digital content available through the Services.
"Points" means gameplay or promotional units awarded through qualifying Trash Bandit activities.
"Rewards" means promotional benefits, merchant benefits, virtual goods, prizes, discounts, cash-value redemption opportunities, or other benefits offered through an applicable program.
"User Content" means content created, uploaded, submitted, generated, published, or otherwise made available by users, including photographs, videos, artwork, Missions, Events, Hideouts, descriptions, reviews, comments, messages, locations, Virtual Treasure, and other content.
"Participating Business" means a third-party merchant, organization, advertiser, sponsor, or business participating in Trash Bandit programs.
2. ELIGIBILITY AND ACCOUNTS
2.1 Age Requirements
The Services are intended for individuals who are 18 years of age or older.
Children under the age of 13 are not permitted to create an Account, access the Services as a registered user, or participate through an Account. Trash Bandit does not knowingly permit children under 13 to use the Services.
If we learn that a child under 13 has created an Account or provided personal information through the Services, we may suspend or terminate the Account and take reasonable steps to delete the child's personal information, subject to applicable legal or record-retention requirements.
Individuals who are 13 through 17 years of age may participate only with the prior knowledge, permission, and consent of a parent or legal guardian and while accompanied and appropriately supervised during real-world Trash Bandit activities by that parent, legal guardian, or another responsible adult specifically authorized by the parent or legal guardian.
A parent or legal guardian permitting a minor aged 13 through 17 to participate must:
- review and agree to these Terms on behalf of the minor;
- authorize the minor's participation;
- accompany or ensure appropriate adult accompaniment and supervision during real-world activities;
- determine whether each Mission, Bounty, Trash Bounty, location, Event, Treasure Hunt, cleanup activity, or other activity is safe and appropriate for the minor;
- ensure that the minor complies with applicable laws, property restrictions, safety requirements, and these Terms; and
- accept responsibility for supervising the minor's participation to the maximum extent permitted by law.
Minors may not independently use features designated as adult-only.
The following features are restricted to users who are 18 years of age or older:
- marketplace selling;
- auctions;
- cash redemption;
- financial payouts;
- seller accounts;
- receiving marketplace proceeds;
- payment account connections; and
- other financial or transactional features designated by Trash Bandit as adult-only.
Trash Bandit may require age verification or evidence of parental or legal guardian authorization.
We may restrict, suspend, or terminate access where these requirements are not satisfied.
Nothing in these Terms limits rights or protections afforded to minors under applicable law.
2.2 Account Registration
Certain Services require an Account.
You agree to provide accurate, complete, and current information.
You are responsible for:
- maintaining the security of your login credentials;
- all activity conducted through your Account;
- protecting your device;
- notifying us promptly of suspected unauthorized access;
- maintaining accurate contact information; and
- maintaining accurate payment or payout information where applicable.
You may not sell, transfer, rent, share, or allow unauthorized persons to use your Account.
2.3 License to Use the Services
Subject to these Terms, Trash Bandit grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services for their intended purposes.
All rights not expressly granted remain reserved.
3. USER RESPONSIBILITY AND REAL-WORLD PARTICIPATION
3.1 Your Decisions Are Your Responsibility
Trash Bandit provides technology, entertainment, information, maps, game mechanics, user content, and location-based experiences.
Trash Bandit does not make real-world decisions for you.
You are responsible for deciding:
- whether to participate;
- whether to travel to a location;
- whether to enter or approach an area;
- whether conditions are safe;
- whether an activity is suitable for your health, fitness, equipment, abilities, experience, and circumstances;
- whether you have lawful permission to enter a property;
- whether weather and environmental conditions are appropriate;
- whether to interact with another person;
- whether to participate in a cleanup activity;
- whether to attend an Event;
- whether to retrieve a Physical Bounty;
- whether to collect trash;
- whether to approach an animal;
- whether to cross a roadway;
- whether to climb;
- whether to swim;
- whether to enter remote terrain; or
- whether to continue or stop an activity.
If you believe an activity is unsafe, unlawful, inappropriate, suspicious, or beyond your abilities, do not participate or stop participating immediately.
3.2 Participation Is Voluntary
Participation in all real-world Trash Bandit activities is voluntary.
You are never required to:
- enter a location;
- pick up an object;
- interact with another person;
- complete a Mission;
- participate in PvP;
- attend an Event;
- retrieve a Physical Bounty;
- collect trash;
- approach an animal;
- cross a roadway;
- climb;
- swim;
- enter remote terrain; or
- perform any action you believe is unsafe.
No Point, Reward, Virtual Treasure, achievement, ranking, or other game benefit is worth risking personal safety.
4. ASSUMPTION OF RISK
4.1 Real-World Risks
Location-based and outdoor activities involve inherent and unpredictable risks.
Risks may include, without limitation:
- motor vehicles;
- bicycles;
- pedestrians;
- uneven surfaces;
- cliffs;
- steep terrain;
- falling objects;
- weather;
- extreme temperatures;
- snow and ice;
- bodies of water;
- wildlife;
- insects;
- vegetation;
- contaminated materials;
- pollution;
- construction;
- remote locations;
- poor cellular coverage;
- navigation errors;
- criminal activity;
- encounters with strangers;
- private property;
- restricted areas;
- illness;
- infection;
- bodily injury;
- permanent disability;
- property loss;
- property damage;
- serious injury; and
- death.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS ARISING FROM OR ASSOCIATED WITH YOUR PARTICIPATION IN REAL-WORLD ACTIVITIES CONNECTED WITH THE SERVICES.
You remain responsible for your own personal safety, decisions, actions, transportation, equipment, property, and conduct.
5. LOCATION-BASED GAMEPLAY
Trash Bandit may include:
- interactive maps;
- GPS and geolocation;
- navigation;
- route guidance;
- location verification;
- geofencing;
- landmarks;
- parks;
- public art;
- historical locations;
- businesses;
- other points of interest;
- Missions;
- Challenges;
- Treasure Hunts;
- Scavenger Hunts;
- Trash Bounties;
- community Missions;
- cooperative Missions;
- AR experiences;
- RPG gameplay;
- PvP;
- virtual opponents;
- Hideouts;
- Inns;
- Events;
- player-created Missions;
- Virtual Treasure;
- achievements;
- leaderboards;
- Points; and
- Rewards.
Availability varies by location and may change at any time.
5.1 No Representation About Real-World Locations
The appearance of a location, route, business, landmark, Mission, treasure, or other point on Trash Bandit does not mean:
- it is safe;
- it is open;
- it is publicly accessible;
- entry is permitted;
- a property owner has granted permission;
- Trash Bandit has inspected it;
- Trash Bandit controls it;
- Trash Bandit owns it;
- the information is current;
- conditions have not changed;
- the location is appropriate for you; or
- Trash Bandit endorses the location.
You must independently assess conditions and legality before entering or approaching any location.
5.2 Accessibility
Trash Bandit is committed to providing access to its Services without unlawful discrimination on the basis of disability and to making reasonable efforts to improve the accessibility of its websites, applications, and digital features for users with disabilities.
Where reasonably practicable, Trash Bandit may provide or support accessibility features, accessibility information, alternative methods of participation, or other reasonable modifications designed to improve access to the Services.
Trash Bandit is a location-based platform that incorporates real-world locations and activities, including parks, trails, streets, landmarks, businesses, public spaces, Missions, Treasure Hunts, Trash Bounties, Hideouts, Events, Physical Bounties, and user-created locations. Many of these locations are owned, operated, maintained, or controlled by third parties rather than Trash Bandit.
Accordingly, Trash Bandit does not represent or guarantee that every real-world location, route, Mission, Treasure Hunt, Trash Bounty, Hideout, Event, Physical Bounty, or other activity displayed through the Services will be accessible or suitable for every individual.
Accessibility may be affected by circumstances outside Trash Bandit's control, including terrain, stairs, slopes, trails, surfaces, distance, weather, construction, entrances, transportation, parking, operating conditions, property restrictions, and accessibility facilities provided by third-party property owners or operators.
Users are responsible for considering their individual accessibility requirements and determining whether a particular real-world location or activity is appropriate for them before participating. The absence of accessibility information for a location does not mean that the location is accessible.
Where accessibility information is provided through the Services, such information may originate from users, businesses, public sources, property owners, or other third parties and may not always be complete or current. Users should independently verify accessibility information where appropriate before travelling to or participating at a location.
Users who experience an accessibility barrier when using Trash Bandit's digital Services, or who require assistance accessing a feature, may contact Trash Bandit through the official Support or Contact page. Trash Bandit will consider reasonable accessibility requests and modifications in accordance with applicable law.
5.2.1 Accessibility Information for User-Created Content
Users creating Missions, Events, Hideouts, Treasure Hunts, Bounties, or other location-based content are encouraged to provide accurate accessibility information where known, including information concerning stairs, steep terrain, unpaved surfaces, significant walking distances, wheelchair access, or other physical accessibility considerations.
Users must not knowingly provide false or misleading accessibility information.
The presence or absence of accessibility information does not constitute a guarantee by Trash Bandit that a location or activity is accessible, safe, or suitable for a particular individual.
Nothing in these Terms is intended to exclude, restrict, or waive any accessibility, accommodation, or disability right that cannot lawfully be excluded, restricted, or waived.
6. TRESPASSING AND RESTRICTED LOCATIONS
Trash Bandit does not grant permission to enter property.
You must not enter:
- private property without authorization;
- locked or closed premises;
- railway property;
- active construction sites;
- restricted infrastructure;
- utility facilities;
- dangerous industrial areas;
- military or government restricted areas;
- active emergency scenes;
- disaster response areas;
- environmentally protected areas where entry is restricted;
- areas closed by authorities; or
- any location where you do not otherwise have lawful permission to enter.
Always comply with:
- laws;
- posted signs;
- barriers;
- operating hours;
- property rules;
- park regulations; and
- instructions from property owners, staff, police, emergency personnel, or authorities.
7. SENSITIVE LOCATIONS
Users may not intentionally create or position gameplay content in a manner that interferes with or creates inappropriate activity at sensitive locations.
Trash Bandit may restrict Missions, Hideouts, Events, treasures, or other gameplay around locations including:
- emergency scenes;
- disaster areas;
- hospitals and medical facilities;
- schools;
- childcare facilities;
- private residences;
- shelters;
- correctional institutions;
- military facilities;
- critical infrastructure;
- funeral services;
- cemeteries where gameplay would be inappropriate or prohibited;
- religious services where gameplay would cause disruption; and
- other locations Trash Bandit considers sensitive.
Trash Bandit may remove or relocate content from sensitive areas without notice.
8. TRASH BOUNTIES AND ENVIRONMENTAL CLEANUP
Participation in Trash Bounties is voluntary and performed at the user's own risk.
8.1 Hazardous Materials
Never pick up, touch, move, open, inspect, transport, or otherwise handle an object that appears dangerous or hazardous.
Potential hazards include:
- needles;
- syringes;
- medical waste;
- biological waste;
- chemicals;
- unknown liquids;
- explosives;
- ammunition;
- firearms or weapons;
- leaking batteries;
- damaged electronics;
- asbestos;
- suspected asbestos;
- dead animals;
- human waste;
- sharp objects;
- contaminated materials; and
- any object you reasonably believe could cause injury or illness.
Do not attempt to complete a Trash Bounty involving hazardous material merely to obtain Points or Rewards.
Contact the appropriate property owner, municipality, emergency service, or other authority where necessary.
8.2 Protective Equipment
Users are responsible for determining and obtaining appropriate safety equipment, which may include gloves, footwear, reflective clothing, litter-grabbing equipment, containers, or other protective equipment.
Trash Bandit does not provide or guarantee the suitability of protective equipment unless expressly stated.
8.3 Cleanup Verification
We may require:
- photographs;
- video;
- GPS information;
- timestamps;
- location verification;
- before-and-after evidence;
- disposal evidence; or
- other reasonable verification.
Submitting staged, recycled, manipulated, fabricated, misleading, or false evidence is prohibited.
Trash Bandit may reject, withhold, reverse, or invalidate Points or Rewards where completion cannot reasonably be verified.
9. MISSIONS, GOOD DEEDS AND COMMUNITY ACTIVITIES
Missions may involve:
- exploration;
- recreation;
- environmental improvement;
- community engagement;
- good deeds;
- tourism;
- local businesses;
- landmarks;
- cultural locations;
- cooperative activities; or
- other activities.
A Mission appearing through the Services does not constitute a guarantee that it is safe, lawful, accurate, available, accessible, or appropriate.
Users must independently evaluate every Mission.
Trash Bandit may modify, disable, restrict, or remove Missions at any time.
10. USER-CREATED MISSIONS, HIDEOUTS AND LOCATIONS
Users may be permitted to create:
- Missions;
- Hideouts;
- Events;
- map locations;
- Challenges;
- treasures;
- virtual locations;
- community activities; and
- other game content.
You may not create content that:
- encourages trespassing;
- directs users into dangerous locations;
- creates an unreasonable safety risk;
- falsely suggests property-owner authorization;
- falsely represents affiliation with a business;
- interferes with traffic;
- interferes with public infrastructure;
- targets another person;
- facilitates stalking;
- reveals sensitive personal information;
- directs players to someone's private residence without permission;
- encourages crime;
- violates another person's rights; or
- violates applicable law.
You are responsible for the locations and content you create.
Trash Bandit may relocate, modify, restrict, hide, archive, or remove such content at any time where reasonably necessary for safety, legality, platform operation, or community standards.
11. EVENTS
Users and Participating Businesses may create temporary Events.
Unless Trash Bandit expressly states that it is the organizer, Trash Bandit is not the organizer, host, operator, or supervisor of user-created or third-party Events.
Event organizers are responsible for:
- legal compliance;
- permissions;
- permits;
- insurance where required;
- venue safety;
- supervision;
- staffing;
- event rules; and
- participant management.
Attendance at Events is voluntary and at the participant's own risk.
12. RPG, PvP AND VIRTUAL COMBAT
Trash Bandit may contain:
- role-playing gameplay;
- character progression;
- PvP;
- cooperative gameplay;
- virtual opponents;
- battles;
- boss encounters;
- Hideouts;
- Inns;
- healing;
- virtual items;
- inventories; and
- related mechanics.
These features are game mechanics only.
They do not authorize:
- physical fighting;
- touching another player without consent;
- threats;
- intimidation;
- stalking;
- following another player;
- taking physical property;
- physically blocking another person;
- trespassing;
- harassment; or
- dangerous real-world behaviour.
Virtual combat must remain virtual.
13. AUGMENTED REALITY
AR content may overlay digital objects, treasure, characters, information, or game elements onto real-world surroundings.
AR displays may not accurately represent:
- distance;
- obstacles;
- traffic;
- terrain;
- hazards;
- property boundaries;
- elevation;
- access restrictions; or
- current conditions.
You must remain aware of the real world around you.
Never enter an unsafe, restricted, or unauthorized location because an AR element appears there.
14. ARTIFICIAL INTELLIGENCE
Trash Bandit may use artificial intelligence to generate or assist with:
- Missions;
- Challenges;
- Events;
- recommendations;
- descriptions;
- artwork;
- game content;
- locations; and
- other features.
AI-generated content may contain:
- mistakes;
- inaccurate information;
- outdated information;
- unsuitable suggestions;
- hallucinated information; or
- recommendations inappropriate for current real-world conditions.
AI-generated content is not a safety instruction.
You remain responsible for evaluating the legality and safety of every AI-generated activity.
15. VIRTUAL TREASURES, ITEMS AND COLLECTIBLES
Trash Bandit may permit users to:
- discover;
- create;
- earn;
- collect;
- use;
- display;
- trade;
- transfer;
- buy;
- sell;
- auction; or
- exchange
Virtual Treasure and other digital content.
15.1 Rights in Virtual Items
Unless expressly stated otherwise, acquiring Virtual Treasure provides only the rights expressly associated with that item within or through the Services.
Acquiring Virtual Treasure does not transfer ownership of:
- Trash Bandit's software;
- trademarks;
- platform;
- game systems;
- source code;
- databases;
- technology;
- characters owned by Trash Bandit; or
- other Trash Bandit intellectual property.
15.2 Digital Artwork
Purchasing digital artwork or user-created digital content does not automatically transfer copyright, trademark rights, moral rights, or other intellectual property rights.
Any intellectual property transfer must be expressly stated.
15.3 Gameplay Changes
Trash Bandit may modify the characteristics, rarity, functionality, balance, appearance, or availability of virtual items where reasonably necessary to operate or improve the Services, subject to applicable law and existing contractual rights.
16. POINTS, REWARDS AND ACHIEVEMENTS
Users may earn:
- Points;
- achievements;
- badges;
- rankings;
- virtual items; and
- Rewards.
Qualifying activities may include:
- exploration;
- Missions;
- Treasure Hunts;
- Trash Bounties;
- community activities;
- Events;
- sponsored activities;
- achievements; and
- other gameplay.
16.1 Nature of Points
Points are gameplay or promotional units.
Points are not, by themselves:
- legal currency;
- bank deposits;
- securities;
- stored-value bank accounts;
- investment products; or
- guaranteed cash.
Earning Points does not automatically create a right to receive cash.
Only Points qualifying under an applicable redemption program may be exchanged for Rewards or cash-value benefits.
16.2 Redemption Programs
Eligible Points may be redeemable for:
- merchant Rewards;
- discounts;
- virtual goods;
- promotional benefits;
- prizes;
- cash-value Rewards; or
- other benefits specifically offered.
Redemption may depend on:
- minimum thresholds;
- verification;
- location;
- age;
- merchant requirements;
- availability;
- expiration;
- fraud checks;
- taxes;
- identity verification;
- program limits; and
- other disclosed conditions.
16.3 Changes to Redemption Programs
Trash Bandit may prospectively establish or modify:
- earning rates;
- redemption rates;
- thresholds;
- program limits;
- participating merchants;
- eligibility requirements; and
- available Rewards,
subject to applicable law and any existing rights that cannot lawfully be modified retroactively.
16.4 Fraud and Reversals
Trash Bandit may reject, withhold, reverse, cancel, or invalidate Points and Rewards obtained through:
- GPS spoofing;
- fake cleanup evidence;
- manipulated photographs;
- manipulated videos;
- fabricated Mission completion;
- botting;
- automation;
- multiple-account abuse;
- collusion;
- bug exploitation;
- marketplace manipulation;
- false identity information;
- fraudulent transactions; or
- other violations of these Terms.
17. PARTICIPATING BUSINESSES AND SPONSORED REWARDS
Participating Businesses may provide:
- Missions;
- promotions;
- Rewards;
- discounts;
- incentives;
- Events;
- sponsorships;
- cash Rewards; or
- other offers.
Unless expressly stated otherwise, the Participating Business is responsible for its:
- products;
- services;
- offers;
- availability;
- redemption conditions;
- payment obligations;
- eligibility requirements; and
- fulfillment.
Listing a business does not necessarily constitute Trash Bandit's endorsement.
Where a Participating Business sends a payment or e-transfer directly to a user, the transaction is between the Participating Business and the recipient unless otherwise expressly stated.
Trash Bandit is not responsible for a Participating Business's independent failure to make a payment or fulfill an offer except where applicable law provides otherwise.
18. MARKETPLACE
Trash Bandit may provide an online marketplace through which eligible users can buy, sell, trade, auction, or exchange:
- Virtual Treasure;
- virtual collectibles;
- digital artwork;
- downloadable digital goods;
- user-created content; and
- other approved digital goods.
18.1 Age Requirement
Marketplace selling, auctions, financial payouts, and cash-redemption features are restricted to users 18 years of age or older.
18.2 Seller Responsibilities
Sellers represent and warrant that:
- they have the right to sell or license listed content;
- listings are accurate;
- listings are not misleading;
- content does not infringe third-party rights;
- transactions comply with applicable laws; and
- listings comply with Trash Bandit rules.
18.3 Prohibited Marketplace Conduct
Users may not:
- sell stolen content;
- sell infringing content;
- manipulate auctions;
- conduct fake transactions;
- engage in wash trading;
- inflate prices deceptively;
- misrepresent rarity;
- misrepresent ownership;
- use stolen payment information;
- coordinate fraudulent transactions;
- manipulate marketplace metrics; or
- circumvent required platform fees.
18.4 Marketplace Enforcement
Trash Bandit may:
- remove listings;
- cancel transactions where permitted;
- withhold payouts pending fraud review;
- reverse improperly credited benefits;
- restrict marketplace access; or
- suspend Accounts
where misconduct is reasonably suspected.
19. FEES, PRICING AND COMMISSIONS
Marketplace transactions, Bounties, memberships, purchases, or other Services may carry:
- platform fees;
- commissions;
- transaction fees;
- payment-processing charges;
- taxes; or
- other charges.
Applicable mandatory charges will be disclosed in accordance with applicable law.
Where required by law, displayed prices will include mandatory non-governmental charges rather than adding unavoidable charges only after the user has committed to the transaction.
Government-imposed taxes or other charges may be shown separately where permitted.
20. PAYMENTS AND PAYOUTS
Payments may be handled through third-party payment providers, including Stripe or other providers selected by Trash Bandit.
Users may be subject to the provider's terms and privacy policies.
Trash Bandit does not guarantee continued availability of any payment method.
Where Participating Businesses pay Rewards directly to users, the business remains responsible for that payment unless expressly stated otherwise.
Where Trash Bandit processes or facilitates payouts, users may be required to satisfy:
- age verification;
- identity verification;
- minimum payout thresholds;
- fraud review;
- tax-information requirements;
- payment-provider requirements;
- processing periods; and
- applicable fees.
Users are responsible for providing accurate payout information.
20.1 Taxes
Users are responsible for determining and satisfying their own tax obligations arising from:
- marketplace sales;
- Rewards;
- prizes;
- payouts;
- creator income; or
- other amounts received through or in connection with Trash Bandit.
Trash Bandit may collect, withhold, or report information where legally required.
21. BOUNTY TRANSACTIONS
Where Bounties can be financially funded, all applicable platform allocations, fees, and charges will be disclosed before the user completes the applicable transaction.
Trash Bandit may use different funding or commission structures for different programs, promotions, merchants, Events, or Bounty types.
Where a 70% / 30% Bounty structure is expressly displayed for a transaction:
- 70% is allocated toward the applicable successful Bandit's Reward; and
- 30% supports the Trash Bandit platform.
A Bounty's displayed transaction terms control that Bounty.
Payments may be non-refundable where clearly disclosed and legally permitted.
22. PHYSICAL BOUNTIES
Where the Services permit Physical Bounties, the person placing or adopting a Physical Bounty is responsible for:
- lawful placement;
- obtaining required permission;
- maintenance;
- condition;
- environmental impact; and
- removal.
Trash Bandit does not authorize users to place objects on property without permission.
22.1 Abandoned Physical Bounties
Trash Bandit may permit removal, recovery, or disposal of a Physical Bounty where:
- the responsible user appears inactive;
- the listing has been archived;
- the physical item remains after archival;
- a property owner complains;
- an authority requests removal;
- it appears abandoned;
- it is unmaintained;
- it creates environmental concerns; or
- removal is reasonably necessary for public safety.
Where reasonably practicable, Trash Bandit may attempt to contact the responsible user first.
To the maximum extent permitted by law, the user responsible for the Physical Bounty assumes responsibility for placement, maintenance, and removal.
23. USER CONTENT
User Content includes:
- photographs;
- videos;
- artwork;
- messages;
- posts;
- Missions;
- Events;
- Hideouts;
- location information;
- descriptions;
- comments;
- reviews;
- Virtual Treasure;
- digital creations; and
- other content submitted by users.
23.1 Ownership
Except where specific marketplace, AI, or creator terms state otherwise, users retain ownership of User Content they create.
You remain responsible for your User Content.
You represent that you possess all rights and permissions required to submit, publish, display, sell, or otherwise use that content.
23.2 License to Trash Bandit
By submitting User Content, you grant 1585214 B.C. LTD. d/b/a Trash Bandit™ a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:
- host;
- store;
- reproduce;
- modify;
- adapt;
- publish;
- display;
- distribute;
- communicate;
- transmit; and
- create derivative works from
such User Content as reasonably necessary to operate, improve, promote, market, and provide the Services.
This may include use through:
- Trash Bandit websites;
- applications;
- maps;
- social media;
- advertising;
- promotional materials;
- emails; and
- other Trash Bandit communications.
Where additional consent is legally required for commercial use of a person's name, image, likeness, or other protected attributes, Trash Bandit will obtain such consent as required by applicable law.
24. AI-GENERATED ARTWORK AND CREATOR CONTENT
Trash Bandit may provide tools for AI-assisted:
- artwork;
- avatars;
- flags;
- emblems;
- treasures;
- graphics; and
- other digital creations.
Specific creator programs may have additional terms.
Any revenue-sharing program will specify, as applicable:
- revenue percentage;
- definition of revenue or profit;
- deductions;
- commissions;
- transaction costs;
- taxes;
- refund treatment;
- chargebacks;
- payout thresholds;
- payout timing;
- eligibility; and
- termination rules.
No revenue share is guaranteed unless expressly offered under applicable creator-program terms.
25. PROHIBITED USER CONTENT
Users may not submit content that is:
- unlawful;
- threatening;
- defamatory;
- hateful;
- discriminatory;
- sexually exploitative;
- harassing;
- fraudulent;
- deceptive;
- privacy-invasive;
- infringing;
- malicious;
- dangerous; or
- otherwise prohibited by Trash Bandit policies.
26. COMMUNITY STANDARDS
Users must treat other users and members of the public respectfully.
You may not:
- harass;
- threaten;
- bully;
- intimidate;
- stalk;
- impersonate others;
- publish private information without permission;
- spam;
- distribute malware;
- encourage violence;
- encourage dangerous behaviour;
- misuse communication systems;
- disrupt community activities; or
- use Trash Bandit to facilitate unlawful activity.
27. CHEATING, FRAUD AND PLATFORM MANIPULATION
The following are prohibited:
- GPS spoofing;
- falsifying location;
- fake Trash Bounty submissions;
- manipulated cleanup evidence;
- fabricated Mission completion;
- reused completion evidence;
- bots;
- unauthorized automation;
- multiple-account Reward farming;
- collusion;
- marketplace manipulation;
- auction manipulation;
- bug exploitation;
- unauthorized scraping;
- reverse engineering;
- circumventing technical protections;
- unauthorized access;
- manipulation of Points;
- manipulation of Rewards; and
- attempting to obtain money, Rewards, rankings, items, or benefits through deception.
Trash Bandit may investigate suspected misconduct and reverse improperly obtained benefits.
28. PLATFORM OWNERSHIP AND INTELLECTUAL PROPERTY
Trash Bandit's:
- software;
- source code;
- technology;
- branding;
- trademarks;
- logos;
- designs;
- databases;
- interfaces;
- game systems;
- graphics;
- proprietary algorithms; and
- other proprietary materials
are owned by 1585214 B.C. LTD. or its licensors.
These Terms do not transfer ownership of Trash Bandit's intellectual property.
Users may not reproduce, commercially exploit, reverse engineer, distribute, or create unauthorized derivative products from the Services except where expressly permitted or where applicable law does not permit such restrictions.
29. COPYRIGHT AND INTELLECTUAL PROPERTY COMPLAINTS
A person who believes content available through Trash Bandit infringes intellectual property rights may submit:
- identification of the protected work;
- identification of the allegedly infringing content;
- information sufficient to locate the content;
- contact information;
- an explanation of the complainant's rights or authority; and
- any declaration or signature required by applicable law.
Trash Bandit may remove allegedly infringing content and suspend repeat infringers.
30. THIRD-PARTY SERVICES
Trash Bandit may integrate with third parties including:
- mapping providers;
- payment processors;
- Participating Businesses;
- social networks;
- video platforms;
- analytics providers;
- authentication providers; and
- other technology providers.
Third-party services are subject to their own terms and privacy policies.
Trash Bandit is not responsible for independent third-party services except where applicable law provides otherwise.
Where Google Maps or Google Maps Platform services are used, applicable Google terms may also apply.
31. PRIVACY AND LOCATION INFORMATION
Use of Trash Bandit is subject to the Trash Bandit Privacy Policy.
Location-based functionality may involve processing information including:
- approximate location;
- precise location;
- device information;
- photographs;
- videos;
- Mission activity;
- Account information;
- marketplace activity;
- location verification information;
- interactions with Points and Rewards; and
- other information described in the Privacy Policy.
Users should review the Privacy Policy before enabling location-based functionality.
32. MODERATION AND ENFORCEMENT
Trash Bandit may investigate suspected violations of these Terms.
Trash Bandit may:
- issue warnings;
- remove content;
- remove Missions;
- remove locations;
- remove Hideouts;
- cancel listings;
- restrict Events;
- reverse improperly obtained Points;
- withhold Rewards pending verification;
- restrict functionality;
- temporarily suspend Accounts; or
- permanently terminate Accounts.
Enforcement decisions may consider:
- severity;
- repetition;
- safety;
- fraud;
- financial risk;
- platform integrity;
- community impact; and
- applicable law.
33. ACCOUNT SUSPENSION AND TERMINATION
Trash Bandit may suspend or terminate Accounts that:
- violate these Terms;
- endanger others;
- engage in fraud;
- abuse the Services;
- manipulate Rewards;
- manipulate marketplace activity; or
- create material legal, security, financial, or operational risk.
Users may stop using the Services at any time.
Account termination does not automatically create a right to cash value for:
- Points;
- achievements;
- rankings;
- virtual items;
- unused game benefits; or
- promotional Rewards,
except where an applicable program or mandatory law provides otherwise.
Sections concerning intellectual property, licenses, outstanding payments, releases, disclaimers, indemnification, limitations of liability, and disputes survive termination where appropriate.
34. CHANGES TO GAMEPLAY AND SERVICES
Trash Bandit is an evolving platform.
Subject to applicable law and existing contractual rights, Trash Bandit may add, modify, rebalance, replace, restrict, or discontinue:
- Missions;
- maps;
- locations;
- Points;
- Rewards;
- Virtual Treasure;
- Events;
- gameplay systems;
- AR;
- AI;
- marketplace features;
- virtual items;
- social functionality; and
- other Services.
Where legally required, notice will be provided concerning material changes affecting paid services or existing contractual rights.
35. ELECTRONIC COMMUNICATIONS
Trash Bandit may send transactional or operational communications where legally permitted, including messages relating to:
- authentication;
- security;
- fraud prevention;
- identity verification;
- Account activity;
- purchases;
- marketplace transactions;
- payouts;
- Mission activity;
- safety; and
- customer support.
Marketing and promotional electronic communications will be sent only where permitted by applicable law and subject to applicable consent requirements.
Where legally required, commercial electronic messages will identify the sender, provide required contact information, and provide an effective means of unsubscribing.
Transactional, security, fraud-prevention, and legally required messages may continue where permitted even if a user opts out of marketing messages.
36. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TRASH BANDIT MAKES NO GUARANTEE REGARDING:
- the safety of any location;
- accessibility;
- property permission;
- map accuracy;
- route accuracy;
- GPS accuracy;
- Mission suitability;
- environmental conditions;
- user behaviour;
- AI accuracy;
- User Content;
- merchant performance;
- Reward availability;
- Virtual Treasure availability;
- marketplace value;
- uninterrupted operation; or
- error-free operation.
Maps, locations, Missions, Events, AI content, user-created content, and other information may be incomplete, outdated, incorrect, or unsuitable for current conditions.
YOU ARE RESPONSIBLE FOR VERIFYING REAL-WORLD CONDITIONS BEFORE ACTING.
Trash Bandit does not control all:
- users;
- properties;
- roads;
- trails;
- businesses;
- Events;
- Missions;
- weather;
- environmental conditions;
- user-created locations;
- physical objects;
- or other real-world circumstances.
37. USER ASSUMPTION OF RESPONSIBILITY AND RELEASE
To the maximum extent permitted by applicable law, you acknowledge and agree that:
- you voluntarily choose whether to participate in real-world Trash Bandit activities;
- you remain responsible for your own safety and conduct;
- you are responsible for determining whether any location or activity is safe and lawful;
- you assume the inherent and reasonably foreseeable risks associated with outdoor, location-based, cleanup, exploration, Event, and other real-world activities;
- Trash Bandit does not supervise your real-world activities unless expressly stated otherwise;
- you are responsible for obtaining permission before entering private property;
- you are responsible for obeying applicable laws;
- you are responsible for determining whether your physical abilities and equipment are suitable for an activity;
- you are responsible for interactions you voluntarily undertake with other users, businesses, organizers, and members of the public; and
- you should immediately stop any activity you believe presents an unreasonable risk.
To the maximum extent legally permitted, you release Trash Bandit from claims arising solely from risks voluntarily assumed by you through participation in real-world activities.
This release does not exclude or limit any liability, right, remedy, or statutory protection that applicable law does not permit the parties to exclude or waive.
38. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRASH BANDIT, 1585214 B.C. LTD., AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, MODERATORS, AND VOLUNTEERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO:
- use of the Services;
- inability to use the Services;
- voluntary real-world participation;
- Missions;
- Trash Bounties;
- Physical Bounties;
- Events;
- locations;
- travel;
- navigation;
- AR;
- AI;
- interactions with users;
- participating businesses;
- third-party conduct;
- User Content;
- marketplace transactions;
- Virtual Treasure;
- loss of virtual items;
- loss of Points;
- loss of Rewards;
- loss of data;
- property damage;
- lost profits; or
- interruption of business.
To the maximum extent permitted by law, users bear responsibility for injuries, losses, damage, expenses, or consequences resulting from their own:
- decisions;
- negligence;
- misconduct;
- unlawful conduct;
- unsafe behaviour;
- failure to follow instructions;
- failure to assess conditions;
- trespassing;
- interactions with third parties; or
- voluntary participation in real-world activities.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
Mandatory consumer protections remain unaffected.
39. INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Trash Bandit, 1585214 B.C. LTD., and their directors, officers, employees, agents, contractors, moderators, and volunteers from third-party claims, liabilities, losses, damages, penalties, expenses, and reasonable legal fees arising from:
- your material violation of these Terms;
- your unlawful conduct;
- your fraudulent conduct;
- your negligence;
- your User Content;
- your marketplace listing or sale;
- your Event;
- your Mission;
- your Hideout;
- your unsafe or unlawful user-created location;
- your infringement of another person's rights;
- your failure to obtain permission;
- your misuse of the Services; or
- your violation of applicable law.
This section does not apply to the extent prohibited by applicable consumer law.
40. EMERGENCIES
Trash Bandit is not an emergency service.
Do not use Trash Bandit to report or obtain assistance for:
- medical emergencies;
- fires;
- crimes in progress;
- hazardous materials;
- missing persons;
- dangerous animals;
- accidents; or
- other emergencies.
Contact the appropriate local emergency service or authority.
41. GOVERNING LAW AND DISPUTES
Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Subject to mandatory consumer rights, proceedings may be brought before courts of competent jurisdiction in British Columbia.
Nothing in these Terms removes a consumer's right to rely upon mandatory legal protections or jurisdictions that cannot lawfully be waived.
42. CHANGES TO THESE TERMS
Trash Bandit may update these Terms to reflect:
- new features;
- gameplay changes;
- marketplace changes;
- Reward changes;
- security requirements;
- legal requirements;
- regulatory requirements; or
- changes to business operations.
Material changes will be communicated where required by applicable law.
Changes apply prospectively from their effective date unless applicable law permits otherwise.
If you do not agree to revised Terms, you must stop using the Services.
43. GENERAL TERMS
Severability
If a provision is invalid or unenforceable, the remaining provisions continue in effect to the maximum extent permitted by law.
No Waiver
Failure to enforce a provision does not waive the right to enforce it later.
Assignment
Users may not assign or transfer their rights under these Terms without Trash Bandit's written consent.
Trash Bandit may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, or similar transaction, subject to applicable law.
Entire Agreement
These Terms, together with the policies expressly incorporated by reference, constitute the applicable agreement between the user and Trash Bandit.
Related policies may include:
- Privacy Policy;
- Marketplace Rules;
- Rewards and Points Rules;
- Safety Guidelines;
- Community Guidelines;
- Creator Terms;
- Terms of Sale; and
- other applicable program-specific rules.
If program-specific terms conflict with these Terms regarding that program, the program-specific terms control to the extent expressly stated.
44. UNITED STATES USERS
If you reside in the United States, certain federal, state, or local consumer protection, privacy, contract, or other laws may provide rights that cannot be waived by these Terms. Nothing in these Terms limits or excludes any right or remedy that cannot lawfully be waived. Any limitation of liability, release, indemnity, choice-of-law provision, or other contractual restriction applies only to the maximum extent permitted by the law applicable to you.
